Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the everbud website (everbud.app), the everbud mobile application, and everbud's paid plans (together, the "Service"), operated by YourPace Mentor (Trade License No. TRAD/DNCC/031143/2024, Dhaka North City Corporation, Bangladesh) and its affiliate YourPace Mentor LLC (Wyoming, USA) ("we", "us", "our"). By using the Service you agree to these Terms.
1. The Service
everbud is a personal health and habit tracker that helps you log meals, water, workouts, sleep, journaling, prayer times, and medications, with an optional AI companion. Core features are free. everbud Plus and Family are optional paid plans that unlock additional features.
2. Eligibility & accounts
You must be at least 13 years old to use the Service, or at least 16 if you live in the European Union, the EEA or the UK. If we learn that an account belongs to someone younger, we will delete it. A parent can add a child without a phone as a family member they manage; that child does not have an account. You are responsible for keeping your account secure and for activity under your account. You agree to provide accurate information when signing up.
3. everbud is not medical advice
everbud is a wellness and self-tracking tool. It is not a medical device and does not provide medical, diagnostic, or treatment advice. Its estimates (such as calories from a photo) are approximate. Always consult a qualified healthcare professional for medical decisions, and never disregard professional advice because of something in the app.
4. Paid plans & payment
- Buying on everbud.app: a one-time payment, in Bangladeshi Taka (৳), for 1 month or 12 months of access at the price shown before you pay. It does not renew and you are not charged again. When the period ends, your account goes back to the free plan unless you buy again. Payments are processed securely by our payment partner, SSLCommerz (bKash, Nagad, Rocket and Bangladeshi cards); we do not store your card or mobile-wallet details. Cards issued outside Bangladesh are not accepted: a payment made with one is held and refunded in full.
- Buying in the app (Google Play or the App Store): these are subscriptions that renew automatically at the end of each period until you cancel. Cancel any time in your Google Play or App Store subscription settings; access continues until the end of the period you have paid for. The store charges you, and the store's own refund rules apply to these purchases.
- Paid plans are digital services and are activated on your account immediately after a successful payment.
- If you live in the EU or UK: you normally have 14 days to withdraw from a contract for digital content or services. When you buy a plan, you ask us to start your access immediately, and you agree that your right of withdrawal ends once your access begins. Our Return & Refund Policy still applies.
- Refunds are handled under our Return & Refund Policy.
5. Acceptable use
You agree not to misuse the Service, including: attempting to breach security, reverse-engineer the app, resell access, upload unlawful content or content you don't have the right to share, harass, threaten or impersonate others, or use the Service in any way that harms others or violates applicable law.
6. Your content
You keep ownership of everything you add to everbud: your logs, photos, names and messages. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy and display that content only as needed to run the Service for you: for example to back up your records, and to show your profile photo, cover, group photos, display name and messages to the people you choose to share them with. This licence ends when you delete the content or your account, except for copies others have already received from you (such as messages in a group) and backups that expire as described in our Privacy Policy.
7. Removing content & ending the agreement
- Anyone can report content or a person in the app. We review reports, usually within 24 hours.
- We may remove content, or suspend or close an account, that breaks these Terms or the law, or that puts other people at risk. We will tell you why, unless the law or someone's safety prevents it. If you think we got it wrong, write to hello@everbud.app.
- You can end this agreement at any time by deleting your account in the app (Settings › Delete account) or at everbud.app/delete. Your data is then deleted as described in our Privacy Policy. Deleting your account does not cancel a Google Play or App Store subscription: cancel it in the store.
- Unless the law requires otherwise, a paid plan on an account we close for a serious breach of these Terms is not refunded.
8. Copyright complaints
We respect copyright. If you believe something in everbud infringes your copyright, email hello@everbud.app with the subject "Copyright notice" and include:
- your name, postal address, phone number and email;
- a description of the copyrighted work;
- where the material is in everbud (for example the group name, or a screenshot), in enough detail for us to find it;
- a statement that you believe in good faith the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner;
- your physical or electronic signature.
We will remove or disable the material and let the person who posted it know; they can reply with a counter-notice if they believe it was removed by mistake. We close the accounts of people who repeatedly infringe.
9. Your data & third parties
We do not sell your personal data, and we do not run third-party advertisements in the Service. How we handle your information is described in our Privacy Policy. If you choose to connect an optional third-party service, that service's own terms apply.
10. Intellectual property
The everbud name, logo, app, and content (other than content you add) are owned by us or our licensors and protected by law. These Terms do not grant you any right to use our branding without permission.
11. Limitation of liability
The Service is provided "as is." To the maximum extent permitted by law, we are not liable for indirect or consequential damages, or for any health outcome arising from your use of a self-tracking wellness tool. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.
12. Changes & governing law
We may update these Terms from time to time; material changes will be posted here with a new date. These Terms are governed by the laws of Bangladesh. Continued use of the Service after an update means you accept the revised Terms.
